Ex-worker with asbestosis wins claim against a Baltimore company

A Montana jury has sided with Ralph Hutt who was a working staff at W.R. Grace Co. vermiculite mine and mill in Libby, Montana. The case involves the company who exposed their workers to harmful and deadly asbestos fibers without their conscious knowledge. In the duct-choked workplace the ex-employee, Ralph Hutt, had contracted these harmful fibers and now suffers from advanced asbestosis. The Maryland Casualty Company is said to be the company’s (W.R. Grace Co. vermiculite mine and mill) were the insurers and the advisors of the company. They were well aware of the dangers that the mine and mills possessed and yet their doctors only administered this as a ‘Dust problem’ instead of directly stating ‘asbestos’ in their ‘safety plan’.

The ex-workers, when working in the company, have had various breathing issues, asbestosis, lung cancer and mesothelioma. According to the evident presented at the trial, the technicians and doctors from Maryland Casualty were full aware of the scarring that were prominently present on the annual X-rays of the workers’ lungs, and yet they chose to hide it from the workers. Neither Grace nor Maryland made any approach to inform the workers of their extensively documented condition.Witnesses have also claimed that the workers were intentionally kept in the dark about the increased risk factors. Now that they were retired, it was thought that the costly workers’ compensation claims would be unavailable to be claimed by the workers at the firm.

The Montana Jury, has thus, settled the case with compensating Ralph Hutt will $36.5 Million. More than 800 plaintiffs have filed lawsuits against the Insurance providing company, Maryland Casualty.
